CONTINUING LIABILITY RELEASE, INDEMNITY AGREEMENT AND EXPRESS ASSUMPTION OF RISK (the “Release”)
The undersigned hereby acknowledges, understands, and agrees that martial arts training is inherently dangerous and poses the risk of serious injury or death. The undersigned assumes all risk of participating in martial arts training with the Released Parties (defined below) or at their facilities.
In consideration of, and as an express condition of acceptance of my permission to train on the present date and any future date, with Hendo BJJ or any of the Released parties, and to train at and enter the training facilities, the undersigned AGREES TO ASSUME THE RISKS incidental to such participation.
On my own behalf, and on behalf of my executors, administrators, and assigns, I RELEASE and forever discharge the Released Parties defined below, of and from all liabilities, claims, actions, damages, costs, or expenses of any nature arising out of or in any way connected with my participation in martial arts or other training. I further AGREE TO INDEMNIFY AND HOLD EACH OF THE RELEASED PARTIES HARMLESS against any and all such liabilities, claims, actions, damages, costs, or expenses, including but not limited to attorneys’ fees and disbursements.
I understand that this Release and indemnity agreement includes any claims based on the negligence, gross negligence, or reckless actions or inaction of any of the Released Parties, and covers bodily injury, death, property damage or other harm or damages whether suffered before, during, or after such participation.
The term "Released Parties" for the purposes of this Release includes Larry Shealy, Gail Shealy, and all of their present and future principals, directors, officers, employees, agents, representatives, contractors, instructors, guest instructors, coaches, assistants, students, volunteers, successors, and assigns of each.
Media Release Consent
By signing this Release, I hereby grant Hendo BJJ, and its agents, representatives, and assigns the irrevocable and unrestricted right to use and publish photographs or videos of me, or in which I may be included, for the purposes of promotion, advertising, or other lawful uses as may be determined by Hendo BJJ. This includes, but is not limited to, rights to use these images in their printed and online publicity, social media, press releases, and funding applications. I waive any right to inspect or approve the finished product wherein my likeness appears, and I waive any right to royalties or other compensation arising from or related to the use of the image or recording.
Consent and Release for Minor Participants (if applicable)
I, the undersigned parent or legal guardian of the minor participant named below, hereby consent to the child’s participation and agree on behalf of the child to all terms of this Release and indemnity agreement. I release and hold harmless the Released Parties from any liabilities arising from the minor’s participation in martial arts training at Hendo BJJ. I also grant Hendo BJJ the rights as described in the Media Release Consent to use photographs and videos of my child.
I confirm that I understand the nature of martial arts activities, the minor’s experience and capabilities, and believe the minor to be qualified to participate in such activities. I agree to supervise or ensure appropriate supervision of the minor during all training activities and will inform the instructors of any specific medical conditions or changes in the minor’s health that might affect the minor’s safety or ability to participate fully.
